CASL Anti-Spam Compliance

Canada's Anti-Spam Legislation (CASL) sets rules for sending commercial electronic messages (CEMs). Bidding Fever is committed to full compliance with CASL and respecting your communication preferences.

1. What Is CASL?

CASL (S.C. 2010, c. 23) is Canadian federal legislation that regulates commercial electronic messages, including email, SMS, and push notifications. It requires organizations to obtain consent before sending commercial messages and to provide clear identification and unsubscribe mechanisms.

CASL is enforced by the Canadian Radio-television and Telecommunications Commission (CRTC), the Competition Bureau, and the Office of the Privacy Commissioner of Canada.

2. Types of Messages We Send

Transactional messages (exempt from CASL consent requirements)

  • Bid confirmations and outbid notifications.
  • Auction win notifications and invoice delivery.
  • Payment confirmations and receipt emails.
  • Dispute status updates.
  • Account security alerts (password changes, new logins).
  • Shipping and pickup notifications.

Commercial messages (CASL consent required)

  • New auction announcements from sellers you follow.
  • Platform feature updates and new functionality notices.
  • Promotional offers, discounts, or founding seller invitations.
  • Newsletter and auction roundup emails.

3. How We Obtain Consent

Express consent

When you create an account, you may opt in to receive commercial messages. This is a clear, affirmative action (checkbox or toggle) that is not pre-checked. We record the date, time, and method of consent.

Implied consent

Under CASL, implied consent exists for a limited period when you have an existing business relationship with us — for example, if you have made a purchase, placed a bid, or created a seller account within the past 24 months. We only rely on implied consent for messages directly related to your use of the Platform.

4. Your Right to Unsubscribe

Every commercial email we send includes:

  • A clear, working unsubscribe link.
  • Our sender identification (Bidding Fever Inc.).
  • Our mailing address and contact information.

You can also manage your notification preferences at any time from your account settings. Unsubscribe requests are processed within 10 business days as required by CASL.

5. Identification Requirements

All commercial electronic messages from Bidding Fever include:

  • The name of the sender: Bidding Fever Inc. / Fièvre des enchères inc.
  • Our mailing address.
  • A way to contact us (email or web link).
  • A clear and prominently placed unsubscribe mechanism.

6. Third-Party Sellers

Auction houses (sellers) on our Platform may send notifications about their auctions to registered bidders. These messages are sent through the Bidding Fever platform, and sellers must comply with CASL requirements. We provide sellers with compliant templates and ensure all messages include proper identification and unsubscribe options.

7. Record Keeping

We maintain records of consent for all commercial messages, including:

  • Date and time consent was given.
  • Method of consent (account registration, preference toggle, checkbox).
  • Purpose for which consent was given.
  • Date and time of unsubscribe requests and confirmation of processing.

8. Penalties Under CASL

CASL violations can result in administrative monetary penalties of up to $10 million per violation for organizations. Bidding Fever takes compliance seriously and has implemented technical and organizational measures to ensure all electronic messages comply with CASL requirements.

9. Reporting Violations
